By installing, accessing, registering for, or using Trip Logbook (the “Service”), you agree to these terms in full.
Trip Logbook is owned and operated by ML McCabe trading as Bilateral, a sole proprietorship in the Republic of South Africa. References to “we”, “us”, or “our” refer to ML McCabe trading as Bilateral.
2.1 The “Service” refers to the Trip Logbook mobile application (available on Android and iOS) and the associated websites (www.triplogbook.app and www.triplogbook.co.za).
2.2 “User” or “you” refers to any person who installs, accesses, registers for, or uses the Service.
2.3 By using the Service in any way, you confirm that you have read, understood, and fully agree to these terms.
2.4 If you are unable, unwilling, or do not intend to comply with any part of these terms (including in-app guidance and instructions), you must not install, access, register for, or use the Service. Immediately uninstall the app, delete any related data, and cease all use. Continued use constitutes full acceptance.
3.1 You must fully comply with these terms, all in-app guidance, instructions, recommendations, and warnings (including on data backups, regular trip verification, GPS/device limitations, and understanding external factors).
3.2 The Service is provided for your personal, non-commercial use only.
3.3 Failure to comply with these terms or guidance does not entitle you to any support, remedies, refunds, compensation, or recourse from us.
4.1 You must be at least 18 years old to use the Service.
4.2 By using the Service, you confirm you meet this requirement.
5.1 We may amend these terms at any time.
5.2 Your continued use of the Service after changes constitutes acceptance of the updated terms. Review them regularly.
6.1 We may stop, interrupt, suspend, or discontinue the Service at any time without notice.
6.2 The Service is provided “as is” and “as available”, with no warranties of any kind, express or implied, including uninterrupted operation, reliability, accuracy, fitness for any purpose, merchantability, or error-free performance.
6.3 The Service relies on your device's GPS and other hardware/software, which can be affected by factors beyond our control (e.g., signal strength, weather, terrain, RF interference, device settings, battery, odometer tolerances, or third-party services). Trip logging may not be 100% accurate or complete.
6.4 You must regularly verify and review logged trips for accuracy and completeness before relying on them (e.g., for tax or any official purpose).
6.5 All data (vehicle info, places, trip reasons, routes, logs) is stored locally on your device only. We do not store, back up, or have access to this data on our servers and cannot recover any lost or deleted data.
6.6 You are solely responsible for backing up your data using the in-app backup/export tools (e.g., CSV export) and storing backups securely off-device.
6.7 You use the Service entirely at your own risk, including risks of data loss, inaccuracies, unreliability, or failure.
6.8 Nothing in these terms limits any statutory rights you may have under applicable consumer protection laws (e.g., South Africa's Consumer Protection Act) that cannot legally be excluded.
7.1 You must provide accurate, current, and complete information when registering and keep it updated.
7.2 You may register only one account and must not use another's email or impersonate anyone.
7.3 You are responsible for keeping your credentials secure and for all activity on your account.
7.4 Notify us immediately of any unauthorised use.
8.1 You may cancel your account at any time.
8.2 We may suspend or cancel your account at our sole discretion, without notice or explanation.
8.3 No refunds are provided following any cancellation or suspension.
You may not: modify, reverse engineer, decompile, scrape, automate access, exploit commercially, redistribute, resell, or use the Service/content for any purpose other than personal use; access via unauthorised means (e.g., bots, scripts); or bypass security. Access is only permitted via official app stores and provided URLs.
10.1 You are solely responsible for any content or data you input.
10.2 We may delete content that violates these terms.
10.3 The Service does not provide financial, tax, accounting, or legal advice. Logs/reports are for personal reference only and may not meet official requirements.
10.4 Trip Logbook is independent and not affiliated with, endorsed by, or connected to any government agency, including the South African Revenue Service (SARS – www.sars.gov.za) or the United States Internal Revenue Service (IRS – www.irs.gov).
10.5 You must independently verify all data and consult a qualified professional or relevant tax authority before using it for deductions, compliance, or any official purpose.
All rights in the Service (software, design, content excluding your data) belong to us or our licensors and are protected by law. You receive a limited, non-exclusive, non-transferable license for personal use only, subject to these terms.
To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the one (1) month prior to the claim. We are not liable for data loss, lost profits, business interruption, reputational harm, or any indirect, special, consequential, incidental, or punitive damages.
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, or costs (including legal fees) arising from your use of the Service, your content/data, or breach of these terms.
Your right to use the Service ends immediately upon termination (by you or us). Sections on liability, indemnity, intellectual property, governing law, and disclaimers survive termination.
Your use is governed by our Privacy Policy (available at www.triplogbook.app/privacy), compliant with POPIA (South Africa) and applicable US privacy laws.
This agreement is between you and us only, not Apple, Google, or any app store. They are not responsible for the Service.
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gauteng, South Africa.
Subscriptions to the Service are auto-renewable and managed exclusively through the Google Play Store (Android) or Apple App Store (iOS) (the “App Stores”).
We do not have access to your payment method details and App Store account information. We do not charge your payment method, process transactions, issue invoices, deduct fees, or handle refunds. All billing, payments, renewals, cancellations, and related matters — including the deduction of Google/Apple service and commission fees (15%) and any applicable VAT or taxes (which they collect and retain) — are handled solely by the relevant App Store.
We offer a 30-day full access free trial without requiring an upfront subscription. After the trial, continued full access requires the user to take specific action to subscribe. If no subscription is started, access ends automatically at the trial's conclusion.
If you decide to subscribe: You are solely responsible for managing and cancelling any subscription. Deleting the Trip Logbook app from your device or deleting your Trip Logbook account does not automatically cancel your subscription or stop future billing. Subscriptions will continue to auto-renew and you will be charged until you actively cancel through your Google Play or Apple App Store account settings.
To cancel your subscription, refer to the official instructions from the relevant App Store.
We recommend cancelling your subscription before deleting the app or account to avoid unwanted charges. We do not cancel subscriptions, process refunds, or resolve billing issues on your behalf.
By subscribing, you agree that billing is governed by the applicable App Store’s terms, and you are fully responsible for all subscription management actions.
If any provision is invalid or unenforceable, the remaining provisions remain in full effect.
By using Trip Logbook, you acknowledge these terms protect us from claims arising from non-compliance, ignored guidance, or inherent limitations of GPS-based logging. If you disagree with any part, do not use the Service.
